Refund policy

Original Artworks

Every original artwork by David Pher is a unique, one of a kind work created in the artist's studio.

The David Pher studio takes great care in presenting each available artwork accurately and in professionally preparing original paintings for transport. This Refund and Return Policy explains the conditions applicable to cancellations, returns, refunds and artworks damaged during transport.

Nothing in this policy limits any mandatory consumer rights that apply under applicable law.

Right of Withdrawal for Consumers

If you are purchasing an original artwork as a consumer through david-pher.com or another form of distance contract, you may have a statutory right to withdraw from the purchase.

For consumers in the European Union, the statutory withdrawal period is generally 14 days from the day on which you, or a third party designated by you other than the carrier, receives the artwork.

No reason for the withdrawal is required.

To exercise a statutory right of withdrawal, please inform the David Pher studio clearly of your decision within the applicable withdrawal period.

Returning an Original Artwork

Before returning an original artwork, please contact the studio so that the return can be coordinated appropriately.

Original paintings are valuable and sometimes large or delicate objects. Any return must therefore be prepared and transported in a manner appropriate for the artwork.

The artwork should be returned in the condition in which it was received and, wherever reasonably possible, using the original protective packaging and transport materials.

For artworks originally delivered rolled in a protective tube, the studio may provide instructions for the appropriate return preparation.

For stretched, crated or otherwise specialist transported artworks, please contact the studio before arranging transportation.

Return Shipping Costs

Where permitted by applicable law, the buyer is responsible for the direct cost of returning an artwork following a withdrawal.

Because original paintings may be oversized and require professional fine art handling, specialist transport, custom packaging or a wooden transport crate, return costs can be significantly higher than ordinary parcel shipping.

Where required by applicable consumer law, information concerning foreseeable return transportation costs for goods that cannot normally be returned by post will be provided before the purchase is concluded.

This does not apply where the return results from a defective, incorrect or transport damaged artwork for which the seller is legally responsible.

Under EU rules, consumers can generally be required to bear the direct return costs following a withdrawal only if they were properly informed of this beforehand.

Refunds

Where a valid right of withdrawal has been exercised, refunds will be processed in accordance with applicable law.

For EU consumer withdrawals, reimbursement is generally due within 14 days after the studio has been informed of the withdrawal. Where permitted by law, reimbursement may be withheld until the artwork has been received back or the buyer has provided evidence that it has been returned.

The refund will be made using the applicable payment method unless another method has been expressly agreed.

Any statutory entitlement to reimbursement of standard outbound delivery costs remains unaffected.

Condition of Returned Artworks

Collectors may inspect an artwork as reasonably necessary to establish its nature and characteristics.

If an artwork has been handled beyond what is necessary for such inspection and this results in a loss of value, the buyer may be responsible for that diminished value to the extent permitted by applicable law.

Please do not stretch, frame, varnish, alter, restore or otherwise modify an artwork if you intend to exercise a right of withdrawal.

Damaged Artworks and Transport Damage

Original David Pher artworks are professionally prepared and shipped fully insured.

If an artwork arrives damaged, please contact the David Pher studio as soon as possible.

Please photograph the outer packaging, inner packaging and artwork clearly and retain all original transport and packaging materials. This documentation may be required to process an insurance or carrier claim.

Do not dispose of packaging or arrange repairs before contacting the studio.

Your statutory rights concerning damaged, defective or incorrectly supplied goods remain unaffected. EU consumers have separate statutory protections for goods that are faulty or do not correspond to what was agreed.

Commissioned and Personalized Artworks

Different rules may apply to commissioned artworks or works created specifically according to a collector's individual specifications.

Under EU consumer law, the statutory right of withdrawal does not generally apply to goods made to the consumer's specifications or clearly personalized.

Where a commissioned artwork falls within such an exception, this will be communicated as part of the individual commission agreement.

Statutory rights relating to defective or incorrectly supplied goods remain unaffected.

Studio Purchases

Different withdrawal rules may apply to artworks purchased in person at the studio rather than through a distance contract.

A statutory 14 day cooling off period generally applies to distance and off premises contracts, rather than ordinary purchases made at a trader's physical premises.

Any mandatory rights relating to defective goods remain unaffected.

International Collectors

David Pher sells and ships original artworks to collectors internationally.

Consumer protection and cancellation rights may vary depending on the buyer's country of residence and the circumstances of the purchase. Where mandatory local consumer protection laws apply, those rights remain unaffected by this policy.

International collectors are welcome to contact the studio before purchasing if they have questions regarding returns from a particular country.
